# Drums de Lion — End User License Agreement

This End User License Agreement ("Agreement") is between you ("Licensee") and Frank Acklin / Störsender Studio ("Licensor") for the use of Drums de Lion ("Product").

By installing or using the Product, you agree to the terms of this Agreement.

## 1. Definitions

- **"Software"** refers to the Drums de Lion plugin application, including all scripts, interface code, and configuration files.
- **"Sample Content"** refers to all audio recordings, monolith files (.ch1–.ch20), and sample maps included with or downloaded for the Product.
- **"License Key"** refers to the unique activation code provided upon purchase.

## 2. Dual License Structure

This Product consists of two separately licensed components:

### 2.1 Software — Open Source (GPLv3)

The Software (HISE project files, HiseScript code, XML configurations) is licensed under the **GNU General Public License v3.0** (GPLv3). You may freely use, modify, and distribute the Software under the terms of the GPLv3.

### 2.2 Sample Content — Commercial License

The Sample Content is **proprietary** and licensed under the terms below. The Sample Content is NOT covered by the GPLv3.

## 3. Grant of License (Sample Content)

Upon valid purchase and activation, Licensor grants Licensee a **non-exclusive, non-transferable, perpetual license** to use the Sample Content under the following terms:

### 3.1 Permitted Uses

- Use the Sample Content in **unlimited commercial and non-commercial music productions** (songs, albums, film scores, game audio, podcasts, etc.)
- The resulting musical works may be distributed, sold, streamed, and broadcast without additional fees or royalties
- Install and activate the Product on up to **three (3) computers** owned or controlled by the Licensee

### 3.2 Prohibited Uses

- **Redistribution:** You may not share, resell, sublicense, or redistribute the Sample Content in any form — whether original, modified, repackaged, or as part of another sample library or virtual instrument
- **Isolation:** You may not extract, export, or make available individual samples or recordings from the Product for use outside of the Product
- **Transfer:** You may not transfer your license to another person or entity without written consent from Licensor
- **Circumvention:** You may not bypass, disable, or circumvent the license activation system

## 4. Ownership

The Sample Content was recorded at **Gare de Lion, Wil, Switzerland** in January 2026. All audio recordings remain the intellectual property of Frank Acklin / Störsender Studio. Purchasing a license grants usage rights only — no ownership of the recordings is transferred.

## 5. Activation

- Each License Key permits activation on up to **three (3) computers**
- Activation requires an internet connection
- License validation may occur periodically to verify activation status

## 6. No Warranty

THE PRODUCT IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. LICENSOR DOES NOT WARRANT THAT THE PRODUCT WILL BE ERROR-FREE OR UNINTERRUPTED.

## 7. Limitation of Liability

IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OR INABILITY TO USE THE PRODUCT.

## 8. Termination

This Agreement is effective until terminated. Licensor may terminate this Agreement if Licensee breaches any of its terms. Upon termination, Licensee must destroy all copies of the Sample Content.

## 9. Governing Law

This Agreement is governed by the laws of **Switzerland**. Any disputes shall be resolved in the courts of the Canton of Thurgau, Switzerland.
